2,900 Local Regulations Contradict National Laws

In 2016, over 2,900 Regional Regulations were revoked or revised by the government. 1,733 regency/city-level Regional Regulations (Perda/Perkada) were revoked/revised by the Minister of Home Affairs, and 1,241 regency/city-level Perda/Perkada were revoked/revised by the Governors. These regulations were abolished because they contradicted existing laws and showed indications of human rights violations.

Two channels exist for overseeing Regional Regulations to ensure their alignment with public interest and/or higher-level legislation. First, executive review, where oversight of Regional Regulations is conducted by the President through relevant ministers or governors. Second, judicial review, which can be submitted to the Supreme Court (MA) by interested parties to test the conformity of Regional Regulations with higher-level legislation.
