- Introduction
Welcome to www.databoks.id. Databoks is an economic and business statistics data portal ("Databoks") owned and operated by PT. Katadata Indonesia ("Katadata"). By registering with Databoks, Customers gain wider access to economic and business statistics data. Customers acknowledge and agree that by registering with Databoks, they will comply with all regulations, Terms and Conditions, and additions related to the services they use (hereinafter referred to as the "Agreement").
- Definition
- Account An account created by the Customer before accessing subscription services on the Site.
- Affiliate A company that is a shareholder, subsidiary, controlled or controlling company or related to PT. Katadata Indonesia.
- Activation The registration and package enrollment process through the databoks.co.id site
- Package Fee One of the cost components that will be billed and must be paid by the Customer to Katadata based on the selected subscription type and payment method.
- Derived Data Any information, algorithms, models, indexes, scores or data generated from manipulation or analysis of data and/or combination with other data not provided by Katadata, so the underlying data cannot be viewed as Katadata.
- Force Majeure A condition or event that occurs beyond the expectation, ability and power of the Parties, which directly or indirectly causes the delay or failure of the obligations of the Party or Parties in accordance with the terms and conditions of this Agreement.
- Access and Use
- Every Customer must register by following the steps available at this link and select a subscription package.
- Customers are granted exclusive, non-transferable rights during the applicable Term to access and use the Materials provided to Customers. The exclusive rights granted to Customers are as follows:
- The right to use Materials for research purposes, and to copy Materials into analysis, presentations, legitimate Customer documents, and similar forms of work or research materials;
- The right to create Derived Data and publish limited quotes from Data in printed or electronic documents, graphs, spreadsheets, files, reports, presentations, analysis or other similar media, both internally and for audit and regulatory purposes, consistent with the Customer's normal business activities. Customers may not directly or indirectly resell or derive commercial benefit from providing Materials or Derived Data to third parties;
- The right to send emails, send faxes, download or make prints using Databoks commands and make single prints of Materials accessed or downloaded in any legally permissible manner (collectively referred to as "Official Prints") with the provision that Official prints will retain all copyright and proprietary notices on Databoks and Katadata.
- Customers are required to provide accurate and truthful information during registration, including but not limited to, correct submission and payment information, correct contact information (email, phone, etc.), Payment setup confirmation, status confirmation (e.g. student status), confirmation of Customer's acceptance of this Agreement. Customers are required to notify Katadata of any relevant changes made to the information contained in this Section.
- If others use Databoks with the Customer's Account and/or gain access through the Customer's failure to maintain or secure their account, the following provisions will apply:
- If required by applicable law, the Customer will notify those whose information may have been accessed or used that a Security Event has occurred;
- The Customer will notify Katadata as required by law;
- Such notice will not refer to Katadata or the product through which the Regulated Data is provided, nor will Katadata be identified or referred to in connection with the Security Event, without Katadata's prior written consent;
- The Customer will be solely responsible for all claims that may arise from the Security Event caused by the Customer, and the Customer will fully indemnify Katadata for any third-party claims against Katadata arising from the Security Event; and
- All notices and indemnity claims related to the Security Event will be entirely the Customer's responsibility.
- Fees/Payment
- Every Customer is entitled to a free trial. The Free Trial is free access granted to Customers for 6 (six) months from the date of registration and having access to the site.
- Each Customer will pay according to the package type selected at registration and/or in the following month.
- Customers can make payments via bank transfer (transfer via ATM, m-banking, e-banking, SMS Banking) or by credit card. Katadata uses Payment Gateway partners.
- Katadata is not responsible for exchange rates charged by the Payment Gateway to Customers.
- For transfer payments, Katadata will process transfer proof verification on working days (Monday - Friday) during operational hours 09:00 WIB - 17:00 WIB.
- For bank payments, Customers can transfer to:
BANK NAME : BANK CENTRAL INDONESIA BRANCH : THAMRIN ACCOUNT NAME : PT. KATADATA INDONESIA ACCOUNT NUMBER : 2063012122 - If the credit card is expired, the subscription will automatically be terminated until there is a credit card renewal notified by the Customer.
- All payments are non-refundable. Temporary suspension or cancellation by the Customer before the end of the subscription term will not return the remaining portion of the Customer's subscription fees, including minimum commitments, that have been billed to the Customer's account.
- When a Customer provides credit card information to Katadata, the Customer declares that they are the legitimate Cardholder.
- Any fees charged related to payment, for example to verify card validity, are the Customer's responsibility.
- Any Customer who makes direct payments via Credit Card (auto charge) agrees and reaffirms that Katadata is authorized to charge the Customer's credit card for subscription fees.
- The Customer agrees and consents that any changes to the credit card account and expiration date will be notified to Katadata no later than 3 (three) working days, or the Customer's Account will be canceled.
- The Customer agrees to provide Katadata with a valid payment method and accurate, complete, and updated information required by the subscription registration form. Failure to comply with these terms may result in immediate termination of applicable subscription services.
- Katadata reserves the right to change available payment methods from time to time at its own discretion.
- Katadata may obtain prior approval of the payment method. Based on the Customer's subscription requirements, billing to the Customer's payment method may occur in one of the following instances: (i) at the beginning of the Customer's subscription term, (ii) at the end of the trial period, (iii) at the time of subscription renewal.
- If the Customer purchases an automatically renewing subscription, the Customer agrees that Katadata will charge the payment method on the first day of each billing period for the relevant subscription.
- If a billing attempt fails, the Customer acknowledges and permits Katadata to continue attempting to charge the Customer until successful.
- If billing remains unsuccessful for more than 3x24 hours from the billing failure notification, the Customer agrees that Katadata has the right to immediately revoke the Customer's access to subscription services until the Customer pays or updates the payment method. If the Customer fails to update the payment method within 60 (sixty) days from the payment date, Katadata may cancel the Customer's subscription.
- All types of Packages and payments will be taxed according to applicable tax regulations in Indonesia.
- Renewal and Cancellation of Subscriptions
- After the Term expires according to the Subscription Package, this Agreement will automatically renew each month (each referred to as a "Renewal Term") unless the Customer provides notice of termination no less than thirty (30) days before the end of the Term. During the Renewal Term, either party may terminate this Agreement with thirty (30) days prior notice to the other party. - Katadata and the Customer have the right to terminate or cancel the Customer's Account or specific subscription at any time.
- The Customer agrees that Katadata may terminate the Customer's Account on the grounds that the Customer has violated or acted inconsistently with these terms and conditions and may terminate the contract with written notice or via email regarding the deactivation of the Customer's account.
- Katadata is not obligated to provide refunds if certain accounts or subscriptions are terminated or canceled.
- Some information Katadata collects from Customers may be personally identifiable information.
- Katadata reserves the right at its sole discretion at any time to modify or discontinue, temporarily or permanently, this service (or any part thereof). Notice of such modifications or discontinuations will be provided on the Site whenever possible.
- The Customer agrees that Katadata shall not be liable to the Customer or to any third party for any modification or discontinuation of this service.
- If any Paid Services are suspended or canceled, Katadata may delete or terminate the Customer's access to information contained in the services related to the Customer's use of the Paid Services (including, if applicable, any information in the Customer's Premium service account).
- Katadata disclaims liability for any loss of information as a consequence of the cancellation of this service.
- Amounts paid to Katadata prior to the Customer reporting unauthorized or fraudulent use of the Customer's account will not be refunded. Katadata has the right to close or cancel any Customer Account in the event of abuse or what may be indicated as abuse of the Account or Paid Services.
- Registration
- To use Databoks services, Customers must have a verified Account and therefore must register by providing their name, valid email address, password, account name, mobile phone number and other information ("Registration Data") in accordance with the requirements on the electronic and/or printed subscription form.
- Customers are fully responsible for maintaining the confidentiality of their password and Account for all activities that occur under their Account. Customers agree to:
- Use their Account individually and not share it with others;
- Provide true, appropriate, accurate, complete, current and honest information about themselves when filling out the registration form;
- Maintain and update data to ensure that the information in their Account remains true, appropriate, accurate, complete, current and honest;
- Protect their Account and purchased Package from unauthorized use and fraud;
- Notify in writing or by email to databoks@katadata.co.id in case of unauthorized use or breach of their Account; and
- Customers can change the data they have entered, except for email, into the service at any time by accessing the Settings menu.
- Privacy Policy
- All data registered by Customers and certain other information about Customers is subject to this Privacy Policy and other Terms related to Databoks services, as well as personal data shared by Customers on their Account, which remains the Customer's responsibility.
- By registering for this service, Customers accept, understand and agree to the practices of collecting, Using, and disclosing information as described in Katadata's Privacy Policy and the terms of this service.
- If Customers register as administrators on behalf of an institution, company or other entity, Customers acknowledge that they will have access to Customer Registration data and details related to their use of Databoks services (hereinafter referred to as "Customer Data"), and therefore Customers hereby agree that they will treat Customer Data very strictly in accordance with this Privacy Policy and will not share any Customer Data with third parties and will limit Customer Data to the purpose of using Databoks services.
- Katadata is not responsible for any misuse of Customer Accounts on Databoks Services.
- Advertisers
- Any relationship between Customers and advertiser promotions found on or through Databoks services, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such transactions, are solely between Customers and such advertisers.
- Customers agree that Databoks, Katadata and its Affiliates shall not be responsible or liable for any loss or damage incurred as a result of such transactions or as a result of the relationship between Customers and such advertisers on the service.
- Customers understand and agree that this service may include advertisements and that these advertisements are necessary for Databoks.
- Customers agree that Databoks has the right to run such advertisements with or without prior notice, and without compensation to Customers or other users.
- The manner, mode and extent of advertising by Databoks on Customer Profiles may change from time to time at the discretion of Databoks and Katadata. For use with paid service memberships sponsored through organizations, Customer services will not include advertisements.
- Katadata Responsibilities and Limitation of Responsibilities
- Katadata warrants that the Databoks service you use will comply with all matters as described on this Site.
- Katadata's maximum liability to Customers in relation to Databoks packages is only to the extent permitted by applicable law, and shall not exceed the amount paid by the Customer.
- All data provided is processed data but not primary data, serving only as supporting data for Customer purposes. Katadata does not guarantee differences or inconsistencies in any data used by Customers based on this site.
- Customers understand, agree and are subject to this clause that:
- The Site, services and content provided on this Site carry risks that will be borne by Customers themselves.
- To the extent permitted by applicable law, Katadata expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
- Katadata is not responsible, except to the extent recoverable under law, for failure to store Customer communications or personalization settings; restricted or lost access; bugs or other errors; unauthorized use due to Customer sharing service access; or any damage and/or inadequacy of internet connection or computers used by Customers.
- Katadata does not guarantee that Databoks or its components will be uninterrupted or error-free.
- Customers expressly agree that Databoks, Katadata and its affiliates shall not be liable for loss, damage, claims, capability or incapability or matters such as:
- loss of opportunity;
- loss of data;
- loss of profits;
- loss of customers;
- loss of goodwill;
- indirect, incidental, special, consequential damages resulting from any matters related to the Site, services, or content;
- Other losses allegedly or reasonably suspected to be part of Databoks, Katadata and its Affiliates' responsibilities;
- Any error or omission from online services or any Materials available or not included therein;
- Unavailability or interruption of online services or any of its features or any Materials;
- Customer's use of services or online Materials;
- Loss or damage of any data or equipment in connection with Databoks services;
- Content, accuracy, or completeness of Materials, all regardless of whether Customer receives assistance in Databoks services from Insured Parties;
- Delay or failure in performance beyond the reasonable control of Databoks, Katadata and its affiliates, or
- Any content obtained from the Internet even if obtained or linked from within Databoks services.
- Customers release Databoks, Katadata and its affiliates from all claims, demands, and damages of any kind arising from or in any way connected with disputes between Customers and other Customers arising from and/or in any way connected with the use of this Site and services.
- Katadata is not responsible for temporary or permanent loss of service resulting from changes in Customer email addresses or contact information, whether intentional or unintentional, that have not been communicated to Katadata in accordance with the terms of this Agreement.
- Limited Warranty
- Customer agrees at their own expense to indemnify, defend, and hold harmless Katadata, suppliers, agents, directors, officers, employees, representatives, successors, and assigns from and against any and all losses, damages, and expenses, including attorneys' fees and amounts paid in settlement arising from any and all third-party claims that: (i) arise from Customer's use of Databoks services in violation of this Agreement; (ii) Violate this Agreement and result in infringement of that party's intellectual property rights. Customer shall have the right at Customer's expense to defend and control such matters and Katadata will fully cooperate with Customer in asserting available defenses. This indemnification is contingent upon Katadata promptly notifying Customer of such third-party claims and shall not apply if the claim arises from Katadata's negligence, willful misconduct, or breach of this Agreement.
- Customer agrees that use of Databoks services is at Customer's own risk and Customer acknowledges that the services and materials provided are "as is", and "as available".
- Choice of Law and Jurisdiction
- The terms and conditions and the relationship between Customer and Katadata shall be governed by the laws applicable in the Republic of Indonesia.
- Should any issues and/or disputes arise as a result of this Agreement, the Parties agree to resolve them through mutual deliberation for consensus.
- If the Parties cannot reach consensus, the Parties agree to resolve the dispute at the Indonesian National Arbitration Board (BANI).
- Katadata and Customer agree that any legal action arising from or related to Databoks services must be filed within one (1) year after the cause of action arises; otherwise, such action is permanently barred.
- General Terms
- The Customer is over 18 years of age.
- These terms and conditions will be updated from time to time by Katadata without prior notice to Customers. Customers can read the latest version at any time at databoks.co.id. The use of services and Package types selected by Customers will continue even if there are changes, and Customers are deemed to agree to any changes that apply to these subscription terms and conditions.
- If the Customer does not agree to comply with the current or updated terms and conditions, the Customer may request cancellation of Databoks services or Packages by sending an email to databoks@katadata.co.id
- Katadata and its affiliates cannot and will not be responsible for any loss or damage arising from the Customer's failure to comply with these terms and conditions.
- Not to reproduce, use, copy, sell, resell, or exploit any part of the service with any type of package, use of any Paid Services, or access to any paid services without prior written permission from Katadata.
- In using this service, the Customer agrees not to:
- View and use it for illegal purposes;
- Use it in a manner, or transmit material that is unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, sexually explicit, or any material of an unpleasant nature of any kind;
- Copy, modify, distribute, transmit, publicly display, publicly perform, or create derivative works or use any part of the Services provided or made available by Katadata, Databoks or third parties or resulting from services other than those expressly provided by this Agreement;
- Use this service and site in connection with chain letters, junk mail, surveys, contests, pyramid schemes, or use any distribution list including anyone who has not given specific permission to be included in such process (commercial or otherwise);
- Collect or disseminate information about other Customers, including email addresses, without their consent, or otherwise violate others' privacy or violate publicity or intellectual property rights (including but not limited to copyright, trademark, and patent rights);
- Avoid, disable, or interfere with security-related features or features that prevent or restrict the use or copying of any part of Databoks;
- Use any method to intercept or take over system data or information from Databoks;
- Attempt to gain unauthorized access to services, Customer Accounts, computer systems or networks;
- Violate local, state, national or international laws, rules or regulations, or endanger Databoks or any other person or entity;
- Collect or harvest personally identifiable information, including account names or email addresses from the service;
- Interfere with, damage, disable, overburden, impair, destroy, limit functionality or disrupt services or servers or networks connected to the service, or fail to comply with requirements, procedures, policies of networks connected to the service;
- Allow or facilitate any third party to do any of the above.
- Content Ownership and Intellectual Property Rights
- Customer acknowledges and agrees that all Intellectual Property Rights in the services, Site, all necessary software used in connection with the services ("Software"), and all Content contained in the Site and services are owned by Katadata, Databoks and its licensors and that, therefore Katadata, Databoks and its licensors expressly retain all Intellectual Property Rights in and to the services, Site, Content, and Software. The term "Intellectual Property Rights" means copyrights, trademarks, patents, service marks, trade names, know-how rights, database rights, design rights and other intellectual property rights or equivalent forms of protection, of whatever nature arising anywhere in the world, whether registered or unregistered and including applications for the grant of such rights.
- Customer and third parties are not permitted to copy, modify, create derivative works from, reverse engineer, reverse engineer or attempt to discover any source code, sell, assign, sublicense, grant security interests, or transfer any rights in the Software. In addition, Customer understands that Customer may have to agree to additional terms and conditions before Customer uses such Software or any third-party Content.
- Customer agrees:
- Not to access the Site, services or Content in any manner other than through the means provided by Databoks for use in accessing the services; or
- Not to modify, rent, loan, sell, or create derivative works based on the services or Software, in whole or in part, unless expressly permitted in writing by Databoks, Third Parties or Advertisers that may result in infringement of Intellectual Property Rights.
- Databoks respects the Intellectual Property Rights of others, and we ask our Customers to do the same.
- Katadata is not responsible for content on other sites that Customers may find or access while using the services.
- Materials available on or through Other Sites may be protected by copyright and Intellectual Property laws of any country as well as the terms of subscription to such Other Sites, and not the terms of Databoks services.
- Cookies Policy
By using or accessing this Site, Customers agree and acknowledge that this Site uses Cookies. We use cookies to understand how Customers browse the Site, recognize preferences and provide services appropriate to Customer needs.
- Contact Us
- If Customers have questions or reports regarding any violations of the service terms and conditions or these terms and conditions, Customers may send an email to databoks@katadata.co.id.
- Databoks may contact Customers and send notices, including notices of changes to these service terms and conditions through announcements on this site.
- Miscellaneous
- These terms and conditions constitute the entire agreement between Customer and Databoks regarding Subscription services and supersede any prior agreements, if any.
- If any terms and conditions in this Agreement are deemed unlawful, void or for any reason unenforceable, then such terms and conditions shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
- In the event that any terms and conditions are inconsistent with the regulations or Laws applicable in the Republic of Indonesia, the Customer and Databoks agree to update them accordingly.
- By clicking “I Agree”, the Customer agrees that by using this service, the Customer has read Databoks' agreements, terms and policies, understood, and agreed to be bound by such terms and conditions. This service may be provided to Customers at different levels according to the package type selected by Customers during registration.
