The Constitutional Court (MK) issued a ruling on Tuesday (20/8/2024) that changes the requirements for nominating regional head candidates. Previously, based on Article 40 paragraphs (1) and (3) of Law Number 10 of 2016, a regional head candidate could only be nominated by a party or coalition of political parties that secured at least 20% of the DPRD seats; or obtained at least 25% of the valid votes in the region.
However, with the MK Ruling Number 60/PUU-XXII/2024, regional head candidates can now be nominated by a party or coalition of political parties that do not have DPRD seats, provided they obtain a minimum of 6.5-10% of the valid votes, depending on the number of permanent voter lists (DPT) in the region.
For regions with a DPT between 6 million and 12 million people, such as Jakarta, the minimum vote requirement is 7.5%.
This ruling opens opportunities for parties outside the Greater Indonesia Coalition (KIM Plus) to nominate gubernatorial candidates in the Jakarta Regional Elections.
KIM Plus and Non-KIM Plus Votes in Jakarta
In the 2024 DKI Jakarta DPRD elections, KIM Plus, comprising Gerindra, Golkar, PSI, PAN, Democrat, Gelora, PBB, Garuda, PKS, PKB, Nasdem, PPP, and Perindo, secured a combined vote share of 83.15%.
This "large" coalition has declared its intention to nominate Ridwan Kamil as the gubernatorial candidate for Jakarta.
Under the old rules requiring a minimum of 25% of the vote, KIM Plus was the only coalition that could nominate a gubernatorial candidate in this year's Jakarta Regional Elections.
However, thanks to the new MK ruling setting the vote threshold in Jakarta at a minimum of 7.5%, PDI-P can now nominate its own candidate because its vote share in Jakarta reached 14%.
According to PDI-P politician Masinton Pasaribu, his party will nominate Anies Baswedan as the gubernatorial candidate for Jakarta.
"God willing, there's Anies. So, on August 27th, PDI Perjuangan will nominate Mr. Anies Baswedan," said Masinton, as reported by Metrotvnews.com on Wednesday (21/8/2024).
Meanwhile, other non-KIM Plus parties, namely the Labor Party, the Ummat Party, Hanura, and PKN, still have no chance of fielding a candidate in the Jakarta Regional Elections because their vote share does not reach the threshold, even if they form a coalition.
