Data from the Indonesian Parliamentary Center (IPC) indicates that 47 draft bills (RUU) from the National Legislation Program (Prolegnas) are slated for deliberation in 2024.
These 47 drafts are categorized as open non-cumulative RUU. There are 5 additional RUU categorized as open cumulative.
Open non-cumulative RUU are draft bills that are part of the general Prolegnas stages. Open cumulative RUU, on the other hand, are submitted openly, or at any time, based on need, but may fall outside the general Prolegnas stages.
The IPC explains that the 47 non-cumulative RUU are carry-overs from previous years.
The breakdown shows 22 RUU (51%) from 2022 and 13 RUU (28%) from 2023. This means only 10 RUU (21%) are new proposals for 2024.
Based on their formation stage, the 2024 Prolegnas RUU consist of: 21 RUU (45%) in the drafting stage; 13 RUU (28%) in the first-level discussion stage; 10 RUU (21%) as new proposals; and 3 RUU (6%) in the harmonization stage.
The 10 new RUU proposals in the 2024 Prolegnas are as follows:
* Land Bill (RUU Pertanahan)
* Second Amendment to Law No. 17/2008 on Shipping (RUU Perubahan Kedua UU No.17/2008 tentang Pelayaran)
* Textile Bill (RUU Pertekstilan)
* Second Amendment to Law No. 34/2014 on Hajj Financial Management (RUU Perubahan Kedua UU No.34/2014 tentang Pengelolaan Keuangan Haji)
* Climate Change Management Bill (RUU Pengelolaan Perubahan Iklim)
* Strategic Commodities Bill (RUU Komoditas Strategis)
* Amendment to Law No. 18/2003 on Advocates (RUU Perubahan UU No.18/2003 tentang Advokat)
* Cryptography Bill (RUU Persandian)
* Second Amendment to Law No. 25/2009 on Public Services (RUU Perubahan Kedua UU No.25/2009 tentang Pelayanan Publik)
* International Private Law Bill (RUU Hukum Perdata Internasional)
The IPC considers the number of 47 RUU to be overly ambitious and unlikely to be completed. It suggests that the DPR (House of Representatives) should reconsider which RUU are essential for legal needs of the government and the well-being of the public.
"For example, the Bill on Asset Confiscation for Criminal Offenses," the IPC wrote in a report published on its Instagram page on December 27, 2023.
The large number of RUU, according to the IPC, risks delaying the completion of crucial bills. This is because the time and attention of DPR members are spread thin, especially in the run-up to the 2024 General Election.
