MK Has Handled Thousands of Election Dispute Cases Since 2004

General elections (Pemilu) since the reform era have directly involved the people, thus requiring a mechanism to resolve disputes. The Constitutional Court (MK) has the authority to decide on election result disputes (PHPU) to create clean and democratic elections. From 2004 to the present, the total number of cases received by the MK has reached 2,173.

The highest number of PHPU cases received by the MK occurred in the 2014 election with 902 PHPU petitions. This comprised 866 cases at the DPR/DPRD level, 34 cases at the DPD level, and one case at the Presidential election level. The next highest number of PHPU cases occurred in the 2009 election with 657 cases. The details are: 627 cases at the DPR/DPRD level, 27 cases at the DPD level, and 2 cases at the Presidential election level. Meanwhile, in the 2004 election, there were 274 cases.

PHPU lawsuits in the 2019 election received by the MK to date total 340 cases. This figure is down by 562 cases compared to the 2014 election. For disputes at the DPR/DPRD level, the MK received 329 cases. At the DPD level, there were 10 cases and one case at the Presidential election level. The MK will hold the first hearing for the 2019 Presidential election dispute after case registration on June 14, 2019.
