The Majority of Indonesian Society Feels They Have Not Yet Been Involved in the Discussion of the Criminal Procedure Code Bill

The House of Representatives (DPR) officially passed the Draft Law (RUU) on the Amendment to Law Number 8 of 1981 concerning the Criminal Procedure Code (RUU KUHAP) into law during the 8th Plenary Session on Tuesday, November 18, 2025.

This Draft Law had previously been approved by DPR Commission III to be brought to a second-level discussion at a plenary meeting on Thursday (November 13, 2025). 

A Kompas Research and Development poll conducted before the ratification showed that 72.8% of respondents in Indonesia stated that the discussion of the Draft Law had not involved public participation. 

"This means that the public is still placed outside the policy discussion process, which they should ideally oversee and monitor," wrote a Kompas R&D Researcher in their report on Monday, August 25, 2025. 

Meanwhile, only 17.5% of respondents believed that the discussion of the KUHAP Draft Law had involved citizens, and 9.7% answered that they did not know. 

Furthermore, Kompas R&D found that 72% of respondents did not follow the news regarding the KUHAP Draft Law, followed by 24.6% who did, and 3.4% who did not know. 

"These findings are an initial indication that the discussion of the KUHAP Draft Law, which essentially concerns citizens' fundamental right to legal protection, has not been fully disseminated to the public," wrote Kompas R&D. 

This survey involved 512 respondents from 64 cities in 38 provinces, randomly selected according to the population proportion in each province.

Data collection was conducted from July 14-17, 2025, through telephone interviews. The survey's margin of error was approximately 4.25% with a 95% confidence level, under conditions of simple random sampling.
