Survey: Socioeconomic Status Viewed as Primary Reason for Discrimination in Legal Processes

Discriminatory treatment or bias in legal processes remains prevalent in Indonesia. A survey conducted by the Indonesian National Commission on Human Rights (Komnas HAM) in collaboration with Kompas Research and Development, titled "Public Perception of the Right to Justice," revealed that a majority (76.5%) of respondents believe individuals face discrimination in legal proceedings due to socioeconomic status.

Furthermore, 30.5% of respondents cited education level or knowledge as a reason for discriminatory treatment in legal processes. Eighteen and a half percent (18.5%) attributed such discrimination to ethnicity or origin.

Twelve percent (12%) of respondents identified disability as a basis for discrimination in legal proceedings. Eleven and seven tenths percent (11.7%) attributed it to age.

Other reasons cited by respondents for discriminatory treatment in legal processes included religious affiliation (11.2%), gender (9.5%), transgender status/sexual orientation (3.6%), political backing (0.4%), and other reasons (0.4%).

This survey, conducted from the fourth week of September to the second week of October 2021, covered 34 provinces and employed an interview-based methodology. The survey involved 1,200 male and female respondents aged 17-59. A multistage random sampling method was used, with a margin of error of approximately 2.8%.
