Supreme Court Grants Only 11% of Cassation Appeals in 2022

A cassation appeal is a legal recourse to overturn a decision from the appellate court or the final decision from all judicial jurisdictions. This appeal can only be submitted to the Supreme Court (MA).

Throughout 2022, the MA received 18,454 cassation appeals. 11,518 cases (62.16%) were ultimately rejected, while only 2,208 cases (11.92%) were granted.

"This shows that most appellate court decisions appealed through cassation were accurate and correct in applying the law, so the MA deemed there were no legal grounds to overturn them," stated the MA Registry on its official website.

"The fact that only 11.92% of cassation appeals were granted should be a consideration when filing a cassation appeal. Is there truly a legal reason to overturn the appellate court's decision, or is it merely a 'trial'? If it's merely a 'trial', then the probability of rejection is 88.08%," it continued.

Furthermore, the MA also issued "rejection with amendment" rulings for 4,617 cassation cases (24.92%). This ruling means that the MA deemed there were no grounds to overturn the appealed decision, but certain parts of the ruling needed correction.

"For example, the MA corrected the amount of damages imposed on the defendant because the *judex factie* did not sufficiently consider it. Similarly, in criminal cases, the MA corrected the amount of restitution or the length of the sentence imposed," said the MA Registry.

In addition, there were also *Niet Ontvankelijke Verklaard* rulings, or cassation appeals deemed inadmissible due to formal defects, totaling 163 cases (0.88%), as well as cassation appeals that ended due to withdrawal of the appeal or settlement, totaling 25 cases (0.13%).
